Meeting called to order at 6:11 p.m. by Chairman Levengood.

ITEM NO. 1 - APPROVAL OF MINUTES

    1. Regular Meeting –August 3, 2006

Moved by Mr. Jachym, supported by Mr. Sturdy, to approve the minutes of the Regular Meeting of August 3, 2006, as submitted.

ITEM NO. 2 – NEW BUSINESS

The applicant is requesting five individual variances:

Mr. Kevin Sobol addressed the Board and answered questions regarding the variances requested for rebuilding the Speedway gas station at the corner of Sheldon and Ann Arbor Roads. Mr. Sobol corrected the math error in the variance requested for the canopy setback. Rather than a 1.4 ft. variance, a 1.5 ft. variance is requested.

Mr. Sturdy indicated tentative site plan approval has been given by the Planning Commission, subject to approval by the ZBA of the variances needed. He also noted the criteria have been met that the Zoning Board must consider in granting requests.

The Board also discussed how much more attractive the corner will be when the rebuilding is completed.

Moved by Mr. Sturdy, supported by Mr. Jachym, to grant the five variances requested in Application No. 1428, Kevin A. Sabol, for the Speedway gas station rebuild at 1490 Sheldon Road, including correcting the 1.4 ft. canopy setback variance to be a 1.5 ft. variance.

The following item was added to the agenda:

     2. Consideration of Revised Submission Deadlines for the Remainder
         of 2006.

The Board discussed the need for changing the submission deadlines to correspond with changes in state law.

Moved by Mr. Sturdy, supported by Mr. Levengood to adopt the following revised submission deadlines for the remainder of the 2006:
