Moved by Mr. Bridgman, supported by Mr. Griffith, to accept the minutes of the Regular Meeting of July 11, 2002, as submitted.

ARTICLE XVI Schedule of Regulations, Zoning District R-1-H One Family Residential Districts:
Minimum lot area - 21,780 Sq. Ft.
Minimum width of lot - 120 ft.
Minimum front yard setback - 35 ft.
Minimum side yard setback - 10 ft., total of two = 20 ft.
Minimum rear yard setback - 50 ft.
The applicant is requesting one variance:
The existing primary residence where the proposed garage addition is to be located has a front yard setback of thirty-six (36) feet, six (6) inches. The proposed garage addition - 12' 0" D x 21' 6" W - 258 Sq. Ft., in front of the existing garage, would provide a front yard setback of twenty four (24) feet, six (6) inches. The applicant is requesting a variance for the front yard setback of ten (10) feet, six (6) inches to allow for the proposed garage addition.
Bob Welcker of Well-Mor Contracting addressed the Board and answered questions.
Moved by Mr. Levengood, supported by Mr. Griffith, that Application No. 1310, Well-Mor Contracting, for a variance for the front yard setback of ten (10) feet, six (6) inches at 10127 Red Maple Drive be denied because of the potential of setting a precedent which could create future problems, plus it is totally out of the jurisdiction of the Board to make these kind of changes in light of there being no hardship presented to require a modification.

Minimum lot area - 43,560 Sq. Ft.
Minimum width of lot - 150 ft.
Minimum side yard setback - 5 ft., total of two = 30 ft.
Minimum rear yard setback - 50 ft.
The applicant is requesting one variance:
The existing non-conforming residence where the proposed first floor addition is to be located has a rear yard setback of : fifty (50) feet, eight & three eighth (8 3/8)" inches. The proposed first floor addition - 15', 3" D x 27', 0"W - 411.75 sq. ft., behind the existing garage/bath, would provide a rear yard setback of : thirty five (35) feet, five & one half (5 ½") inches. The applicant is requesting a variance for the rear yard setback of fourteen (14) feet, six and one half (6 1/2") inches.
Mr. Michael Dyorich addressed the Board and answered questions.
Moved by Mr. Bridgman, supported by Mr. Levengood, to grant approval for Application 1313, Michael Dyorich, 12017 Amherst Court, for a variance for the rear yard setback of fourteen (14) feet, six and one half (6-1/2") inches, due to the hardship of location between the pond and river, and that also the current structure is an existing non-conforming structure with a current setback of 35 ft., 6 in. Ayes all.
Moved by Mr. Bridgman, supported by Mr. Zdanek, to adjourn the meeting.
