ITEM NO. 1 - APPROVAL OF MINUTES

1. Regular Meeting – January 4, 2001

Mr. Sprogell moved to approve the corrected minutes of the January 4, 2001, as submitted. Seconded by Mr. Griffith. Ayes all.

ITEM NO. 2 – OLD BUSINESS

Application No. 1132/1249 – Gary Tokar Construction, Inc.

RE: Zoning Ordinance No. 83, Schedule of Regulations, Article 16, 16.1 – Zoning District R-1-H, Minimum lot area 21,780 S. F., Minimum lot width of 120 ft.

The applicant’s proposed landsplit with the proposed N. Territorial right-of-way of 120 ft. would reduce the size of each lot to 0.48 acres vs. the required 0.50 acres. Reducing the front and rear lot widths for parcels A, B and C to the following:

The applicant is requesting nine variances:

The applicant is requesting three variances of 0.02 acres or 871 square feet per each of the three proposed land parcels A, B and C.

The applicant is requesting six variances of the minimum lot widths for parcels A, B and C as follows:

The Zoning Board of Appeals received a letter from Lawrence R. Kindt, resident, requesting a greenbelt zone on the eastern edge of the subject property.

Mr. McIlhargey said the greenbelt issue is between the applicant and the Planning Department.

Mr. Gary Tokar, applicant, addressed the Board and explained the rationale for his request of nine variances.

Karen Miller, resident, addressed the Board and gave her objections for the proposed land parcels and subsequent homes to be built.

Mr. Sprogell moved to grant the request for Application No.1249. A review of the Zoning Board of Appeals minutes of November 6, 1997, for application No. 1132 indicates a variance was granted reducing the size of each of these same proposed land split parcels 871 sq. ft. for reasons stated therein. The lot widths (114 ft) requested in the application (1249) are consistent with application No. 1132 previously approved. Therefore application No. 1249 is approved provided the applicant work in conjunction with the Planning Department on a site plan to provide appropriate landscape buffering to visually separate the three (3) parcels from the adjacent Heather Hills subdivision lots. Seconded by Mr. Griffith. Ayes all.

It was moved by Mr. Griffith and supported by Mr. Sprogell to adjourn the meeting at 5:20 p.m. Ayes all.
